Fluorescent tubes cannot go in a general construction skip. If you are working on a construction site and have to strip the place first, the chances are you will have to deal with fluorescent lighting, linear tubes, compact fluorescent lamps, or high-intensity discharge lamps. This is all lighting needs a separate, specialist collection route.
Fluorescent lighting was introduced to commercial buildings in the 1930s and became a popular choice across various industries. The UK went on to ban the sale and manufacture of T5 and T8 fluorescent tubes in September 2023 because of their mercury content, with all remaining types prohibited by February 2024. Alongside this, many businesses are opting for more sustainable LED lighting now. But that means there are a lot of old lamps in circulation that eventually need to be disposed of.
Although fluorescent tubes look like ordinary light fittings from the outside, inside they are built differently. An electrical current runs through mercury vapour which is what produces light. If you turn off the light or take the light fitting down, that small amount of mercury is still there, in the tube.
The 2005 Hazardous Waste Regulations state that waste products that contain mercury are hazardous. The regulations cover England and Wales, but Scotland has its own similar rules and regulates hazardous and special waste through the Special Waste Regulations 1996. Northern Ireland applies its own Hazardous Waste Regulations which were also established in 2005. Although there are small differences between countries in the United Kingdom, the same principle applies: light fittings that contain mercury cannot be treated as ordinary construction waste. That means they cannot be mixed with other skip contents, and the quantity of waste doesn’t offer an opportunity to reclassify them. One fluorescent tube alone is enough to trigger the classification.
When a site uses a general skip for fluorescent tubes, it’s a breach of duty of care under the Environmental Protection Act 1990. The enforcement risk is the same as any other hazardous waste offence.
Fluorescent lamps are waste electrical and electronic equipment (WEEE). The 2013 WEEE Regulations have different categories for different items. The regulations put flurescent tubes under Category 13. That means fluorescent tubes have two classifications to comply with: they are hazardous waste because of the mercury, and WEEE because they are electrical equipment that have reached the end of their life.
That dual status changes what paperwork is needed. Fluorescent tubes need to travel on a hazardous waste consignment note, not a standard waste transfer note, and the note needs to be retained for three years. This is different from most other WEEE leaving a construction site, where a standard waste transfer note and a two-year retention period apply. Any errors in the process and the compliance gap sits with the site, not the waste collector.
When fluorescent tubes are taken offsite, they need to end up at an Approved Authorised Treatment Facility (AATF) that's officially equipped to handle mercury-containing waste. Not every WEEE collector has this capability.
It can be tempting to break fluorescent tubes before disposal to cut corners then put them straight into the general skip. But when a tube breaks, it releases the mercury vapour into the air and anyone nearby is at risk of inhaling the mercury which can cause respiratory and nervous system problems.
Breaking the tubes would also bring the site under the Control of Substances Hazardous to Health (COSHH) Regulations, which govern exposure to hazardous substances at work. Breaking tubes on site swaps a waste management task into a workplace exposure incident, with obligations that follow from that. Organising a collection of light fittings that are intact and whole from a company that deals with specialist processing, will keep the site compliant and keep people safe.
Before booking a collection for fluorescent lighting, it's worth confirming three things directly with the collector:
The mercury handling capability. Ask whether they process mercury-containing waste themselves or route it through a partner facility with the right permits. It’s always worthwhile knowing exactly where your waste will end up or be processed.
The AATF status. The facility receiving the tubes needs Approved Authorised Treatment Facility status for WEEE, specifically covering lighting equipment.
Hazardous waste permits and a valid waste carrier's licence. An environmental permit for WEEE treatment does not automatically cover hazardous WEEE streams such as mercury-containing lamps - the receiving facility's permit needs to specifically authorise hazardous waste. Confirm the carrier holds a valid upper tier waste carrier registration and that the destination facility's permit covers hazardous waste, before the tubes leave the site
